Please read these Terms of Service ("Terms") carefully before using the ClaimCam mobile application (the "App"). By accessing or using the App, you agree to be bound by these Terms.
By downloading, installing, or using ClaimCam, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
ClaimCam is a mobile application designed for insurance adjusters and professionals to capture, organize, and export photos for insurance claim documentation. The App provides:
You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or guardian. The App is intended for professional use by insurance adjusters and related professionals.
You must create an account using Sign in with Apple to use the App. You are responsible for maintaining the confidentiality of your account credentials.
You agree to provide accurate and complete information when creating your account and to update it as necessary.
You are responsible for all activities that occur under your account. Notify us immediately at claimcam@hunersapps.com if you suspect unauthorized access.
ClaimCam offers the following subscription plans:
Subscriptions are processed through Apple's In-App Purchase system. Payment will be charged to your Apple ID account upon confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds for partial periods.
We reserve the right to change subscription prices with 30 days' notice. Price changes will not affect your current subscription period.
New users are eligible for a 7-day free trial. If you do not cancel before the trial ends, you will be automatically charged for the subscription. You may cancel during the trial period without charge.
You retain all rights to the photos, job data, and other content you create using the App ("Your Content"). You grant us a limited license to store, process, and display Your Content solely to provide the App's services.
You are solely responsible for Your Content and must ensure it complies with all applicable laws. You represent that you have all necessary rights to upload and use Your Content.
You may not upload content that:
While we provide cloud backup, you are responsible for maintaining your own backups of Your Content. We are not liable for data loss.

The App, including its design, features, and functionality, is owned by ClaimCam and protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to use the App for your personal or business use in accordance with these Terms.
ClaimCam and related logos are trademarks of ClaimCam. You may not use our trademarks without prior written permission.
The App integrates with third-party services including:
Your use of these services is subject to their respective terms and privacy policies.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the App will be uninterrupted, error-free, or secure. We do not warrant the accuracy or reliability of any content or data.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAIMCAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
Our total liability to you for all claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless ClaimCam and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:
You may terminate your account at any time by using the "Deactivate Account" feature in Settings or by contacting us at claimcam@hunersapps.com.
We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we deem harmful to the App or other users.

Your continued use of the App after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that you may bring claims in small claims court if they qualify.
You agree to resolve disputes on an individual basis and waive the right to participate in class actions or class arbitrations.
If you access the App via Apple's App Store, you acknowledge and agree that:
You agree to comply with all applicable export and import laws and regulations. You may not use or export the App in violation of U.S. export laws.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ClaimCam regarding the App and supersede all prior agreements.
